Protection of Traditional Knowledge Within the Framework of Treaty on Intellectual Property, Genetic Resources and Associated Traditional Knowledge of 2024

Traditional knowledge constitutes a vital part of the cultural identity of human communities, developed and transmitted across generations. It has played a fundamental role in the daily lives of these communities, particularly in areas such as food security, agriculture, medicine, and others. Biotechnology has been closely linked to this knowledge, serving as a key to exploring biodiversity and managing environmental resources sustainably. However, this knowledge has not received sufficient recognition in legal systems, especially within the framework of intellectual property rights, leaving it vulnerable to unlawful appropriation. As the economic value of this knowledge has increased, so has the need for a comprehensive international legal framework to protect it. The World Intellectual Property Organization (WIPO) sought to address this by drafting a dedicated international instrument and established the Intergovernmental Committee on Intellectual Property and Genetic Resources, Traditional Knowledge, and Folklore (IGC) in 2000. After over two decades of efforts, a Treaty on Intellectual Property, Genetic Resources and Associated Traditional Knowledge was adopted in 2024. This research examines the provisions of this treaty and evaluates its mechanisms and effectiveness in protecting traditional knowledge.
