Problems of Applying International Humanitarian Law - ISIS Crimes As An Example

Abstract

International humanitarian law is a set of laws and rules aimed at protecting individuals and civilians not participating in armed conflicts. These laws, rules, and agreements between states and organizations work to safeguard citizens and populations from the negative effects of wars and protect them from military operations occurring during conflicts.

International humanitarian law forms a vital legal framework designed to protect individuals and civilians during armed conflicts, with a focus on providing care and protection for the most vulnerable individuals exposed to the negative impacts of international and internal armed conflicts. The goals of these laws and rules are to define the boundaries and rules that should govern military actions and ensure the practice of mercy and humanity in the face of human suffering.

Despite numerous international agreements and significant efforts to enforce and compel the application of international humanitarian law, these efforts face various obstacles and problems hindering the universal enforcement of these laws and agreements. Until now, the application of this type of law has not gained mandatory status. It has only been applied in several cases, lacking permanent and consistent rules for its application in all situations, weakening the practical role of these laws and agreements.

Crimes committed by ISIS are among the prominent offenses committed in the last decade worldwide, having international and regional dimensions. However, the shortcomings of international humanitarian law in prosecuting and punishing the perpetrators of these crimes have been evident. All attempts at international recognition of the crimes committed by the organization have not achieved significant success for various reasons, hindering the implementation of international humanitarian law
